| 1. Our Products |
| 1.1 All items shown for sale are available
for delivery to the vast majority of
addresses in the UK, Channel Islands,
Republic of Ireland and Isle of Man,
some areas may not be covered and in
this instance we will inform you promptly. |
| 1.2 We aim to deliver some flowers
in bud to increase vase life. |
| 1.3 Products are subject to availability.
If we are unable to supply your chosen
item we reserve the right to substitute
a product of equivalent value and quality
without notice. |
| 1.4 If we are unable to provide your
chosen item or a suitable subsitution
we will advise you as soon as possible
and refund your payment in full. |
| 2. Prices |
| 2.1 Prices listed are valid for a
maximum of 14 days after placing your
order. |
| 2.2 For deliveries within the UK,
Ireland and Channel Islands, prices
include VAT but exclude delivery charges.
The standard delivery charge for orders
to United Kingdom, Channel Islands and
Republic of Ireland addresses is £4.99
rising to £6.99 for same working
day delivery. Same working day delivery
includes orders placed after 5pm on
the last working day (Monday-Saturday)
immediately proceeding the requested
delivery date. |
| 3. Orders / Payment |
| 3.1 In order to fulfill your order
we require all necessary fields contained
within the order form to be completed
with the relevant information. We accept
payment by all major credit and/or debit
cards. By submitting your order and
payment details, you are consenting
to be bound by our terms and conditions
contained in these Terms and Conditions
and appearing anywhere on the site www.netflora.co.uk. |
| 3.2 Submitting your Order Form is
subject to our acceptance of this offer
when we issue a written confirmation
of acceptance by e-mail to the e-mail
address with which you have supplied.
This message will re-confirm the total
cost of your order. We will not consider
ourselves bound by a contract with you
until we have issued this confirmation.

| 3.3 We cannot accept orders from customers
who are less than eighteen (18) years
of age. |
| 4. Delivery |
| 4.1 Delivery charges (see above) will
be applicable within the UK, Ireland,
Isle of Man and Channel Islands. If
you request delivery to remote areas
which are not normally delivered to
by a member florist you will be advised
of any additional charges as soon as
possible upon receipt of your Order
Form. |
| 4.2 Timed deliveries are not available
as clearly stated on the order form,
should a timed delivery therefore be
requested we will not be bound in any
way to honour such a request. |
| 4.3 On acceptance by us of your Order
Form we will advise you by e-mail confirmation
of the intended delivery date. For same
day delivery within the UK, Ireland,
Isle of Man and Channel Islands we must
receive your Order Form by 12pm BST.
We will process Order Forms received
on Sundays or Public Holidays the next
working day. We do not deliver on Sundays
or public holidays. |
| 4.4 Where incorrect personal and delivery
details have been supplied problems
or delays in delivery may result, therefore
please ensure that you have included
the full address details, including
accurate postcode of the intended recipient
and your daytime telephone number or
e-mail address so that we can notify
you in the event that any delivery problems
occur. |
| 4.5 Whilst we will make every effor
to ensure that delivery is made on the
requested date you acknowledge that
actual delivery will be via a local
florist and in very rare circumstances
delivery on the requested terms will
not be possible. In this event you will
be given prior notice wherever possible
and we shall either make alternative
arrangements or shall refund your payment
in full in accordance with clause 1.5
above. |
| 4.6 Where a third party is involved
during delivery, such as hospitals,
airports, hotels and ships, the signature
of any person authorised to accept delivery
on behalf of the organisation shall
be accepted as proof of delivery to
your chosen recipient. |
| 4.7 In the instance of there being
difficulties in delivering your order
to the intended recipient we (including
the florist or third party delivering
your order) reserve the right to contact
the recipient using the contact details
you provide on the Order Form. |
| 4.8 On the order form we allow you
to specify additional delivery information
where such guidance may be helpful –
for example to a floor number, hospital
ward or other relevant property details.
We reserve the right to not action any
delivery requests specified in this
field which we deem unacceptable such
as requests for timed orders etc. |
| 5. Cancellation |
| 5.1 Orders may be amended or cancelled
up to 24 hours before the intended delivery
date for UK, Ireland and Channel Islands. |
| 5.2 To amend or cancel your order,
please contact the our Customer Service
Team from 9am until 5pm Monday to Saturday
using the contact details set out in
Section 6 below. |
| 6. Customer Services |
| 6.1 In the event that you are not
satisfied with the service any complaints
should be addressed in the first instance

| 6.3 Because of the perishable nature
of our products in order to assist us
in resolving any complaints quickly
and to our mutual satisfaction, we advise
you to make any complaint within 1 working
day of the date of delivery or intended
delivery of your purchase. |
| 7. Disclaimer |
| 7.1 Whilst we agree to use our reasonable
endeavours to ensure that the Netflora
Site and/or the Netflora Service is
fully operational and error-free we
cannot guarantee this and, therefore,
accept no responsibility for any defects
and/or interruption of the Netflora
Site and/or the Netflora Service and
shall be released from our obligations
under these Terms and Conditions in
the event of any cause beyond our reasonable
control which renders the provision
of the Netflora Site and/or the Netflora
Service impossible or impractical. |
| 8. General |
| 8.1 We reserve the right to amend
the Terms and Conditions on which you
are permitted access to the this site
and/or the Netflora Service when we
see fit. The Terms and Conditions in
force will be those as displayed on
this site at the time and date your
order is placed. We require that you
always read these terms and conditions
before placing your order and we provide
a link on the product page you have
chosen to these terms and conditions. |
| 8.2 Additionally, we reserve the right
to suspend, restrict or terminate access
to the Site and/or the Netflora Services
for any reason at any time. |
| 8 .3 These Terms and Conditions shall
be deemed to include all other notices,
policies, disclaimers and other terms
contained in the Netflora Site, provided
that in the event of a conflict between
any such other notices, policies, disclaimers
and other terms, these Terms and Conditions
shall prevail. If any of these Terms
and Conditions is held to be invalid
or unenforceable, the remaining provisions
shall remain in full force and effect.

with the requirement of all current
data protection legislation including,
without limitation, the Data Protection
Act 1998 (as replaced, modified or re-enacted
from time to time). We shall only use
personal data received from you for
the purpose of fulfilling our obligations
under these Terms and Conditions and
as stated in our Privacy Policy. |
| 8.5 A person who is not a party to
the agreement between you and us has
no rights under the Contracts (Rights
of Third Parties) Act 1999 to enforce
any of the Terms and Conditions but
this does not affect any right or remedy
which exists apart from that Act. |
8.6 Save in respect of fraudulent
misrepresentation, this agreement (including
any documents and instruments referred
to herein) supersedes all prior representations,
arrangements, understandings, and agreements
between you and us (whether written
or oral) and sets forth the entire agreement
and understanding between you and us
relating to the subject matter hereof.

| 8.7 Your purchase will be deemed to
have occurred in the UK. These Terms
and Conditions shall be governed by
and construed in accordance with English
Law and the parties agree to submit
to the exclusive jurisdiction of the
English courts. |

may be occasionally restricted to allow
for routine maintenance. |
